HOW IT WORKS

You take a brief from a client.

You prepare the concept plans and wish to send them to your client electronically.

Before emailing the concept to your client you send them a customized email letter that asks them to either acknowledge your copyright in the plans - in which case you will send them the plans via email - or if they don't wish to acknowledge your copyright -they can visit your offices to view the plans.

Once they acknowledge – yes or no - a response is sent to you via email, with date, time, and computer id of the sender – captured in the database -on file for future reference.

You send your client a customized email:

Your plans area now ready for you to view.

Before we forward the plan to you, we would respectfully ask that you read our copyright statement to signify your acceptance of our ownership of this intellectual property.

Once we have received your response we will either:-

A. 'Yes' - you accept our ownership of this plan - then forward our plan to you for your perusal.

Or

B. 'No' - you do not accept our ownership of this plan - then you can always view the plan by appointment in our offices.

Whereas:

The Owner has either seen a design from (Your business name inserted) and has asked for the plan to be modified to suit the Owners’ specific needs, or the Owner has given a brief to the (Your business name inserted) to formulate a concept and plan uniquely for the Owner.

(Your business name inserted) has prepared the plan and now wishes to send the plan to the owner electronically.

The owner acknowledges that the design is a product of the imagination of the (Your business name inserted) and its use by other person(s),without the written consent first obtained from the (Your business name inserted), is hereby prohibited.

Any breach of the copyright of the design, or unauthorized use of the design by the Owner, or any party, at the direction or on behalf of the Owner, will result in damages being incurred by

(Your business name inserted) agreed at 5% (this value is customizable) of the expected contract value for that design.

It is a common misconception that a change of 10% of the plan negates the copyright.

Copyright exists in whole or identifiable part of the plan regardless of the change.
